Terms of Use
These Terms of Use ("Terms") govern your access to and use of the TrendMeld mobile application, website, and related services (collectively, the "Service") provided by TrendMeld LLC ("TrendMeld," "we," "us," or "our").
1. Eligibility
You must be at least 13 years old to use TrendMeld. If you are under the age of legal majority where you live, you may use TrendMeld only with the permission of a parent or legal guardian. You must be legally permitted to enter into these Terms.
2. Your Account
You are responsible for providing accurate account information, keeping your login credentials secure, and all activity performed through your account. Notify us promptly if you believe your account has been compromised.
3. What TrendMeld Provides
TrendMeld is a creator-planning and idea-generation tool. It may surface public trend information from YouTube and use AI to create original creator directions, hooks, scripts, shot lists, titles, captions, hashtags, and related Remix Pack material.
TrendMeld does not guarantee views, virality, revenue, engagement, channel growth, monetization eligibility, or any other result. Trend data and AI output are tools for planning and must be evaluated by you before publication.
4. YouTube and Third-Party Content
YouTube videos, thumbnails, titles, channel names, trademarks, and other third-party content remain owned by their respective owners. TrendMeld does not transfer ownership of third-party content to you and does not grant a license to copy or republish someone else's protected content.
You are responsible for ensuring that anything you publish complies with copyright, trademark, privacy, publicity, platform, advertising, and other applicable rules. TrendMeld is not affiliated with, endorsed by, or sponsored by YouTube or Google.
5. AI-Generated Material
TrendMeld uses third-party AI services, including OpenAI, to produce Remix Packs. AI output may be incomplete, inaccurate, outdated, repetitive, similar to other material, or unsuitable for your purpose. You must review and edit output before relying on or publishing it.
Do not rely on TrendMeld output as legal, medical, financial, tax, investment, safety, or other professional advice. If your content discusses regulated or high-stakes topics, you are responsible for independent verification and appropriate professional review.
Subject to applicable law and third-party rights, TrendMeld permits you to use Remix Pack output generated for your account for your own lawful content creation. TrendMeld does not guarantee that any AI-generated output is copyrightable, unique, non-infringing, or free of third-party rights.
6. Acceptable Use
You may not use TrendMeld to:
- violate law, regulation, court order, or another person's rights;
- copy, download, scrape, redistribute, or exploit YouTube or other third-party content in a way prohibited by the applicable platform or rights holder;
- attempt to obtain or store another person's YouTube credentials or private account data;
- bypass usage limits, subscription controls, security measures, or technical restrictions;
- reverse engineer, attack, disrupt, overload, or abuse TrendMeld or its service providers;
- use automated means to access TrendMeld except where we expressly permit them;
- submit malicious code, unlawful content, or content intended to deceive, harass, exploit, or harm others.
7. TrendMeld Pro Subscriptions
TrendMeld may offer an auto-renewable subscription called TrendMeld Pro. The price, billing currency, taxes, and subscription period shown by the App Store or Google Play at the time of purchase control your transaction.
- TrendMeld Pro currently includes up to 200 Remix Packs per billing period.
- Unused pack allowance does not accumulate or roll over into later billing periods unless TrendMeld expressly states otherwise.
- Your subscription automatically renews unless you cancel it through the applicable store before renewal, subject to that store's rules.
- Canceling renewal does not normally end access immediately; paid access generally remains available until the end of the already-paid subscription period.
- Deleting your TrendMeld account does not automatically cancel an App Store or Google Play subscription.
- Refund requests are handled under the policies of the store that processed the purchase and applicable law.
TrendMeld may change plan features or pricing prospectively. Any price change is subject to applicable store rules, notice requirements, and your rights under applicable law.
8. Free Plan
TrendMeld may provide a limited free allowance. The current free plan includes three Remix Packs per account unless the app states otherwise. Free access may be changed or discontinued prospectively, subject to applicable law.
9. Ownership of TrendMeld
TrendMeld and its software, branding, interface, designs, databases, non-user content, and underlying technology are owned by TrendMeld LLC or its licensors and are protected by applicable intellectual-property laws. These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service as intended.
10. Account Suspension and Termination
We may suspend or terminate access if we reasonably believe an account is being used fraudulently, unlawfully, abusively, in violation of these Terms, or in a way that threatens TrendMeld, users, service providers, or third parties. Where practical and legally appropriate, we may provide notice or an opportunity to correct the issue.
You may stop using TrendMeld at any time and may initiate account deletion from the app's Settings screen.
11. Service Changes and Availability
TrendMeld relies on third-party services such as YouTube APIs, AI providers, hosting infrastructure, app stores, and RevenueCat. Those services may change, fail, impose limits, or become unavailable. We may modify, suspend, or discontinue parts of TrendMeld when reasonably necessary to maintain, secure, improve, or legally operate the Service.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TRENDMELD DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RESULTS, EXCEPT TO THE EXTENT A WARRANTY CANNOT LEGALLY BE DISCLAIMED.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRENDMELD LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITY, GOODWILL, OR CONTENT PERFORMANCE ARISING FROM OR RELATED TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRENDMELD'S TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TRENDMELD THROUGH THE APPLICABLE APP STORE FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless TrendMeld LLC from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful use of the Service, content you publish using TrendMeld output, your infringement of third-party rights, or your material violation of these Terms.
15. Privacy
Our Privacy Policy explains how TrendMeld handles information. Certain features may require a separate consent before information is sent to a third-party AI provider or otherwise processed in a way that requires affirmative permission.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules, except where applicable consumer law requires otherwise. Subject to any rights you have under mandatory local law, disputes that are not resolved informally will be brought in a state or federal court with jurisdiction in Minnesota.
17. Changes to These Terms
We may update these Terms when TrendMeld, applicable law, or platform requirements change. If a change materially affects your rights, we will provide notice where required. Continued use after the effective date of updated Terms constitutes acceptance to the extent permitted by law.
